To Whom It May Concern:
The following is a brief explanation of
the circumstances, which prevented me, from being able to continue with my
classes, last year, beginning in the Month April/May: 2015. I will explain what
occurred, last year, as well as present evidence, to support my case. I am
requesting:
1.
Immediate re-entry, into my previous Post
Masters Certificate Doctoral Studies Program-where I left off, in my studies. I
am working towards the Ph.D., in Business Administration, with a
specialization, in Advanced Accounting;
2.
Total grade forgiveness, for the: Failing
grade that I was given. I was earning, almost straight:”A’s,” prior to the
circumstances, that arose last year, that were beyond my control, as I will
prove, here today, in this presentation, of both: information, and evidence.
More evidence, is available, upon request, if required, for you to make a final
determination, in my case, and appeal to the Dean;
3.
An immediate removal, of the academic
debt, which accumulated, when I was not able, to continue forward, with my
studies, due to circumstances, that were, well beyond my control.

and for your continued consideration, patience, and assistance, regarding the matter,
briefly stated.
It was May, of 2015, that my adopted
mom, Susan Cary, Esq., and I were having disagreements, about how she has:
mistreated, and abused me, for over 16 years now. My adopted mom, Susan Cary,
Esq., has a number of my belongings, that she stole from me, and, that she
refuses to return to me. Additionally, my adopted mom, refuses to allow me to
speak to my 3 children, and to talk to them, on the telephone, on a regular
basis. When I complain, about how she abuses me, she gets irrationally angry at
me, and she: Baker Acts me, with her legal degree, to a mental hospital-when I
am not mentally ill. Last year, in May 2015-I complained to another of
authority figures, about my adopted mom, continuing to pretend, as though, I am
seriously mentally ill-when I am not.
My adopted Mom, Susan Cary, Esq., got
angry with me-again, for complaining about how severely she abuses. I posted
the complaints, about my adopted mom, online, along with my: N.C.U. homework
assignments, and, my other complaints. My complaints, in regards to how, my
adopted mom abuses me, and my children, are not: fictitious, unhealthy, or
unreasonable. I have been complaining about how my adopted mom, abuses
me-illegally, to Federal authority, in the U.S., since: 2007, and, the: F.B.I.
and C.I.A.-have never responded to any of my numerous complaints, that I am
aware of.
Due to the extremely dangerous
position, that I have been in, in relation to my adopted mom, for over ten
years now, last year, I began making plans, to apply for political asylum, in
Europe. I have told my adopted mom, over and over again, that I am not leaving
my 3 children, here in the U.S., while I go to Europe, to seek political
asylum, because of how abusive, she is to me-and with no consciousness-it is
illegal.
I am not seriously mentally ill, and my
adopted mom, Susan Cary, Esq., sends me to a mental hospital, when she is angry
at me. My adopted mom and I, discussed my continued dissatisfaction, with how
she treats me, over and over again, last year, before I began complaining
online-again. Local law enforcement, does not respond to my complaints, about
my adopted mom-either. She does, whatever she wants to do, regardless of who
speaks to hear, about how she treats me, or, my 3 children. Her behaviors
towards me, are illegal, a great deal of the time, and her treatment of me,
does not alter-even after she has lost to me, in the American court system,
with: a psychiatrist and Judge, who speak to her in court. My adopted mom,
walks out of the court room, and then decides, that she could care less,
because she does not: like, or agree with, the Judges final decision, in the
case.
The last time, that my adopted mom,
sent me to a mental hospital, for no legal reason, was while I was enrolled at:
N.C.U.. My adopted mom, did not like my homework assignments, that were posted

Then, my adopted mom, did not like the nonprofit organization, that I
established, as a homework assignment: Emergency International Internet Relief.
Then my adopted mom, did not like the fact that, I want to plead for political
asylum, and move my company with me overseas. Then, my adopted mom, did not
like the fact, that I do not want to leave my 3 children here in the U.S.,
while I am establishing my nonprofit, and attending law school, in the U.K..
Then, my adopted mom, did not like the fact, that I hired: Lexington Law, for
credit repair-because she ruined my credit, and I could not qualify, for
anything, that I needed: housing, employment, student loans, credit cards, bank
accounts, etc..

Contact Information Regarding Illegal Psychiatric Care at Shands At Vista, in
Gainesville, FL U.S.A.:

Everything, that I have clearly stated above
for you, was explained by a psychiatrist, at: Shands at Vista Mental hospital,
here in Gainesville, FL U.S.A.. None of the reasons mentioned above-my adopted
mom’s, continued complaints about me-none of them, are indications of any
mental illnesses. I requested, many times, for public defenders, in: Alachua
and Baker county, to please assist me, with obtaining a free copy, of the
transcripts, from mental health court. I am indigent. I have almost no money.
The public defenders, should have been willing to assist me-however, my adopted
mom, is also trained as a public defender, and Alachua county, is her
community. The public defenders of both: Alachua and Baker county, refused to
assist me, in obtaining copies, of the mental health court hearing transcripts.
The first hearing, began on: May 7,
2015. I could not afford any of the transcripts, however, I desperately need
the transcripts, for International Human Rights Court, in Europe. I was
recently able to purchase, just the last hearing date, which occurred on: May
21, 2015. The transcript cost me: 130.00 dollars, that I do not have to spend.
I should be receiving, the 21 pages, later this week, from the Gainesville,
FL-Alachua County Courthouse, and I will happily send you a copy, of what was
said, in mental health court, as soon as I receive it. I will post a copy of

Receipt for Mental Health Court Records: Shands At Vista: Gainesville, FL
U.S.A.
May 21, 2015:

It was illegal for me to
be sent to Shands at Vista. I am not seriously mentally ill. My adopted mom,
has used something called an: Ex-parte, to send me into Shands at Vista, and
Meridian-both mental hospitals here in Gainesville, FL U.S.A.-over and over
again, when I was not: psychotic, manic, depressed, delusional, hallucinating,
suicidal, or experiencing any other serious symptoms, related to a mental
illness. I object every time, and my adopted mom, writes whatever she needs to
write, on the referral paperwork to Shands at Vista, to give the hospital
reason, to illegally detain me there. Although her reasons are lies, the staff
at Shands at Vista, never listen to my explanations, and pretend, along with my
adopted mom, like I have a variety of problems, and mental illnesses, that do
not exist.
However, for the first time-that
I am aware of, although it may have happened before, my medical insurance
provider, finally agreed with me, that the illegal mental health, medical care,
that: my adopted mom, and Shands at Vista, was forcing me to accept, was
unnecessary medical treatments. My medical insurance, determined that the
inpatient treatment, from Shands at Vista mental hospital, was unnecessary
care-in fact, Medicaid fraud. Prestige, my medical insurance provider, made
their correct determination, in June, of 2015. However, upon receiving the
information, from my insurance carrier, Shands at Vista, refused to alter their
care of me. I was tortured-over and over again, the entire time I was there,
just as I am, every time, that I am illegally sent there, for unwarranted,
mental health, inpatient medical care.

While I was at: Shands at
Vista, this past time: 2015. No: blood, urine, or E.K.G. reading, were taken. I
was forced to take, psychotropic medications, that I have never required. I had
heart palpitations, from my well established heart murmur. I requested a heart
specialist, when I began to have some heart pains, from the medications. My
requests were denied.
I suffered from excruciating pain,
from pervious injuries, that I came to the hospital with, from prior attempts
on my life, in the community. The doctor refused to proscribe and effective
pain medication. I was sexually harassed, by staff at Shands, and by other
patients. I was assaulted, by a patient at Vista-who was then promptly discharged.
I was illegally placed on phone restriction, over and over again, for reasons
that were not real. Over two weeks went by, when I was not allowed to speak to
the general practitioner. I was over dosed on the medications-again. I am
abused and tortured, every time I am illegally admitted to a mental hospital,
and, for mental health issues, that do not exist.

Fraud Claim:

Shands at Vista, in June
of 2015, refused to cease and desist, with their unnecessary, unsafe, and
unwarranted care of me. I called N.C.U., when I was allowed phone access, which
was rarely, to attempt to explain the circumstances-which were clearly beyond
my control. I was doing very well in studies, with: N.C.U., up until the point,
when my adopted mom, became irrational, and locked me up in the mental facility
again, because she again, was angry with me, and not because, I was having a
serious mental health problem.
Shands at Vista Mental Hospital is
extremely dishonest, and should be closed-forever immediately. The staff at
Shands at Vista, sent me to the State Mental Hospital, although, they knew, and
have known, for years, that I do not have a serious mental disorder, and, the
force care, is illegal. Just prior to being sent to Shands at Vista, last year,
I began filing courts cases, against Shands at Vista, and individuals who
assist them-such as my adopted mom: Susan Cary, Esq., in repeatedly: torturing,
abusing me, and illegally detaining me, for extended periods of time, every
other year. The hospitalizations are illegal.
I began cases with: The Hague,
and The International Criminal Court, as well, as: The European Court of Human
Rights. I informed the: State Attorney, in Gainesville, FL and The Public
Defender’s Office, of Alachua County, that I had already begun to process my
cases, and neither cared. When I told police in Gainesville, FL, that I was
taking the problems with my adopted mom, to an International Court overseas,
they told me, that they did not care, that they too, are doubtful, as to how an
International Court, will impact a case of: Torture-Civil and Human Rights Abuses,
here in America. I seriously think, that disregarding the cases that I have
begun filing, through the International Court system, is the wrong attitude to
have. My cases are valid, and do have merit.
When my adopted mom, illegally locked
me up, in Shands at Vista, last year, for mental health care, that I have never
required, she stole my belongings. My adopted mom, has a history of stealing my
things from me. My adopted mom, stole my belongings, and filed the police
report, on my stolen belongings herself, after she herself, stole-at least some
of my belongings, which are listed, on the police report. That is a serious
problem for me, and, for other people as well. It is my sincere opinion, from
my interactions with my adopted mom, that she sends anyone to a mental
hospital, that she wants to, with her law degree, when people do not do, what
she wants them to do. I have complained to the Florida Bar Association Members,
on a number of occasions, with no response, or reply.

Some of My Things-Herself:

I recently, had to amend
the police report, that my adopted mom, filed last year, after she returned
some of my stolen items. My adopted mom, returned, all of my stolen cellphones,
a digital camera, batteries, and wires. My five years, of hard
work-investigative journalism, both: pictures and video, had been completely
erased, and all cellphones, are no broken. My adopted my, illegally locked me
in a mental hospital, stole some of my most valuable work from me, reported
that it had been stolen by someone else, and completely destroyed, all of my
records of work, with no care, or apology.

Two days ago, my adopted
mom, Susan Cary, Esq.-returned more of my belongings to me. When she returned
some of my belongings to me, she gave me paperwork, stating, that she had
finally paid, a Cox Cable Internet bill, that she was supposed to have paid,
last year. Last year, I had contracted, with: Lexington Law, because my adopted
mom, has a long history, of ruining my credit. My adopted mom, would get angry
at me-all my bills would be paid on time, then, she would send me to a mental
hospital, for soo incredibly long-almost a year each time, that I would not be
able to pay on my bills on time, although, I would normally pay on time. I am responsible,
with money. My adopted mom, did it over and over again, until my credit got soo
bad, that I could not get approval, to rent anywhere, for housing. I tried
negotiating, and paying the debts off myself. However, after a number of years,
the problem, became too much for me to deal with on my own, and that is where:
Lexington Law, came into the picture.

When my adopted mom, finally paid
the bill owed to Cox Cable, just recently, she also just returned my router,
that she stole from my apartment last year. I was not able to list, everything,
that had been stolen from my apartment last year, because my adopted mom, filed
the police report. I never saw the scene of the crime, she had me illegally
detained, at: Shands at Vista, for mental health care, that I clearly, did not
require. She stole something else from me, and then, just provided me with the
evidence. I have to amend the police report, from last year-again!

My Adopted Mom’s Typing, And Explanation About, How She Just Returned My Stolen
Modem, And About How She Just Paid, The Cox Internet Bill, That She Agreed To
Pay, Last Year, With The Cash Money, That I Gave To Her-My Credit Is Ruined

When my adopted mom gets angry with me,
she locks me up in a mental hospital, and she steals all of my belongings. My
adopted mom ruins my credit-intentionally, so I cannot gain anything I need. My
adopted mom, tries to ruin my academic records, by interrupting my studies, and
by stealing documentation that I require to write research papers. My adopted
mom, says things to people, that are not true, as well, and tries to ruin my
reputation. My adopted mom, steals my post mail, etc. My adopted mom, also
calls various businesses, that I contract with online, and elsewhere, and she
changes the address on file, to her home address, with my name still intact,
although, I have not been allowed inside of my adopted mom’s house, in years.
When I visit my 3 children, at my
adopted mom’s house, I am forced, to: pee, and to defecate, on the front porch,
because she does not want me to ever come into, any of her homes, ever again,
because, I take my belongings back, and, I take pictures, of the house falling
apart, and of all of the mess, that she never cleans. I have posted photos

There are also photos,
posted to the above Flickr websites, of the extreme tortuous circumstances,
that I have experienced, since my adopted mom, in 2010-kicked me out of my
home, and stole all of my belongings, and left me, with ruined credit, to look
for: employment, and housing, and anything else, that I need.
When my adopted mom, sent me to a
mental hospital, to steal from me-not only did she interrupt my studies again,
and not only did she ruin my studies again, and not only did she ruin my
reputation again, and not only she broke a lease on me, she also interrupted
the advancement, of my business. It was stated in court, that my adopted mom,
thought that I was mentally ill, for establishing, a nonprofit business. No one
would hire me in the U.S.. I was illegally “Blacklisted,” so I established a
nonprofit: Emergency International Internet Relief, and, I hired myself. My
adopted mom, was really upset, that I finally had a legitimate and legal title
and entity, to share my business under.

Because I have been so
severely abused and mistreated at Shands at Vista, and by many of the same
psychiatrist, for a number of years. I requested formal complaints forms. I
want the psychiatrists, who have knowingly abused me, for over 16 years, at
Shands at Vista, to lose their licenses, to practice medicine. Closing the
psychiatric facilities, at Shands at Vista, would never be enough. The
psychiatrists, would open a new unit, under a new name, and, they would simply
locate, to somewhere else, in the U.S., or somewhere else in the world, to
practice illegal psychiatry. “No! I object!”

I have been, as
proactive, as I can possibly be, with constant complaints-even from within
mental facilities. Complaints, here in the U.S., have not gotten me far enough.
When I was transferred, from Shands at
Vista, I was sent to the state mental hospital. I have been to Macclenny State
Mental Hospital before, because my adopted mom, has sent me there before, for
no reason. I have seen the Judge there before, in mental health court, with my
adopted mom. The last time, I saw the mental health Judge, at Macclenny, FL, he
told my adopted mom, that any problems, that occurred, at her
property-mildew/mold and plumbing issues, were her fault, because I reported
over and over again, that the house required repairs, and she refused to fix them.
The Judge, and the psychiatrist, have also told my adopted mom-before, that I
am not seriously mentally ill, and that I do not belong in a mental health
facility. My adopted mom, did not like the Judges opinion. She refused to
listen to the Judge, and, she sent me to the mental hospital, again, an
again-after that, when nothing was wrong-again.

My diagnosis at Northeast
Florida State Mental Hospital, after I was discharged by the Judge, and court,
from the hospital, for the second time, is: Depressive Disorder-NOS. Depressive
Disorder-NOS, is not a serious depression problem. My depression, if and when I
am not happy enough, is related to how my adopted mom abuses me, to my
homelessness, to my lack of financial resources, to the fact that I miss my
children, etc. I am not suicidal, or a threat to myself, or to anyone else.

Examples
of disorders in this category include those
I do not
suffer from a major depression, that makes it difficult for me to function. I
sometimes suffer, from a: minor and brief, depression. You also have to keep in
mind, that the definitions, of various mental illness change, and are defined
in different ways, by various psychiatrist-that does in no way mean, that I
gain new problems, that did not previous exist for me, when someone else,
changes the definition, of any given disorder. The following, is my
explanation, of: Depression NOS, that I provided, for my psychiatrist, at:
N.E.F.S.H.:
March 16, 2015, Bayo Elizabeth Cary, Diagnosis: Depressive Disorder NOS 311
General Depression
Depressive Disorder Not Otherwise Specified (DD-NOS) is designated by the code 311 in the DSM-IV for depressive disorders that are impairing but do not fit any of the officially specified diagnoses. According to the DSM-IV, DD-NOS encompasses "any depressive disorder that does not meet the criteria for a specific disorder."
For most
people who suffer the condition, their life will be significantly affected
Depressive Disorder NOS can make many aspects of a person’s daily life
difficult to manage, inhibiting their ability to enjoy the things that used to
make them happy. Sufferers of the disorder tend to isolate themselves from
their friends and families; they tend to lose interest in some activities,
experience behavioural changes and sleeping disorders.
DSM
IV-TR classification
Minor
depressive disorder: episodes of at least 2 weeks of depressive symptoms but
with fewer than the five items required for Major Depressive Disorder.
Symptoms of the disorder may arise
due to several reasons. These include:
- Distress due to medical conditions
- Environmental effects and situations
Treatment
It is possible for this disorder to
progress over time. A patient suffering from the disorder can improve the
condition with treatments. There are several types of therapies that may
improve the condition, but depending on a patient’s experience of the disorder
or the cause of the disorder, treatments will vary.
- Psychotherapy including behaviour therapy, Gestalt therapy, Adlerian therapy, psychoanalytic therapy and existential therapy.
- Pharmacotherapy through medications including antidepressants.
Comments: The medicine Zoloft
improves my condition significantly, whereas medications, which are classified
as anti-psychotic medications, cause my state of mental health to deteriorate.
Anti-psychotic medications, cause me to become severely depressed, to the point
of becoming suicidal, and they cause me to become psychotic, and mentally, and
emotionally unstable. I was
misdiagnosed, for many years, as bipolar, and schizophrenic, the anti-psychotic
medications, associated with the treatment of those disorders, were detrimental
to my well being.
The following, is a list of all of the medications,
that I was taking, when I was discharged from: N.E.F.S.H. . I was not taking
any psychotropic medications. I do not require a maintenance medication. I am
rarely depressed, and when I am-it usually passes, quite quickly.

As
previously stated, when my adopted mom send me to a mental hospital, it not
only negatively impacts my grades, when I am enrolled in school, it interrupts
every other daily activity as well. I still have creditors, who are contacting
me-although I have paid off balances, on many credit accounts, that were in
good standing, that I could no longer pay on, because my adopted mom, illegally
sent me, to a mental hospital, and then, I was detained, for almost a year, on
every occasion.

Against My Credit Score-Even After, They Agreed, That The Card, Was A Pre-Paid
Credit Card, And Could Not Really Be Overdrawn:

I send negative news,
about my credit into Lexington Law, right away. I do not know, what I would do
right now, without the powerful assistance, of the sizable legal team, and
professional expertise, that are available to me, through Lexington Law. In addition,
to problems with my credit, because my adopted mom, has repeatedly ruined my
credit, I also have to be seriously concerned about identity theft, that
Lexington Law, also helps with.
My adopted mom, Susan Cary, Esq.,
steals my post mail, as well as my personal documents. Other people, have also
illegally stolen my post mail, and other personal documents. I need a new
Social Security number. I have requested a new U.S. Social Security number,
several times, and given very good reasons, for the request. I have reported
my: Social Security card stolen, to the: U.S. Social security Office, and to
the: U.S. F.T.C., and, I have never received any response, from the U.S.
government.
When my adopted mom, illegally locked
me, in a mental hospital, last year, to be tortured, and abused, because she
was angry at me, I missed an appointment, to have my driver’s license replaced,
with the Tax Collectors Office, here in Gainesville, FL. My driver’s license
was suspended, by court order-just because I missed an informal appointment, to
present a minimal amount of information, regarding my ability to drive a
vehicle safely. It will be costly, to have my driver’s license re-instated,
and, it is another blemish, on my permanent record, that my adopted mom, has
illegally, and unnecessarily caused me, and with no apology-again!

My Permanent Driving Record, Because of Circumstances, Beyond My Control-I
Could Not Make It To An Appointment. Another Costly Problem For Me-Caused By My
Adopted Mom:

I have friends at:
N.E.F.S.H.-other patients, who have been tortured and abused, by members of
their family, and others, as well. Many are being illegally detained, for
familiar, and sociopolitical reasons. When I was at N.E.F.S.H., someone stole
my Florida voters registration card, which shows, that I am a designated
Republican, for voting purposes, in the U.S. . In addition, while I, and other
patients, were being tortured and abused at N.E.F.S.H, staff would walk around
sometimes, telling us, that no one cared about how we were being mistreated,
because: Obama said it was fine, and Obama is calling again tonight, and, if
you do not do what you are told, then, Obama, will be informed, and you will
suffer, the consequences.
I am a Republican. I did not vote for Obama. I
do not like Obama. However, other patients, did care a great deal, and were
stressed out, by the idea, of the President, of the U.S., disliking them, for
refusing to do something. Some of my friends, are soo distraught, about the
situation at N.E.F.S.H., and how they arrived there, and about how they are
treated while they are there, that some of them spoke with me, and agreed to
sign a petition, to be heard in an International Court, in order to support, my
nonprofit organization: Emergency International Internet Relief, and, to better
help themselves.

In addition, to sincerely
wanting to complete my Ph.D. in Business Administration, through Northcentral
University, I am also pre-legal. I established my nonprofit organization, while
working towards my Ph.D. at: N.C.U., so that I would be better able to assist
my: vulnerable clients, after I am accepted to law school. I intended to
establish 1 dollar stores, in Europe, to support my nonprofit organization,
with the knowledge that I gain, while studying for my Ph.D. . I will apply for
the: 20,000.00 Kick-Start scholarship, through: N.C.U., after I complete my
post masters certificate, to pay for the remainder of the classes I need, to
earn my full Ph.D. . I would like to assist people, with: International Court
cases, dealing with violations, of: Civil and Human Rights Pro Bono-sometimes,
if possible, if my dollar stores, are able to collect enough revenues, to
positively support my efforts.
When I was discharged from
N.E.F.S.H., this past January, of 2016, after having been illegally detained in
the mental health system-again, for almost another year, I had no housing. My
adopted mom, broke my lease last year, when she illegally locked me up, for
problems that were not mental health issues-again. My adopted mom-although my
homelessness, is entirely her fault, did not want to help me with housing. I
have other relatives in the U.S.-that even speak to me. I had no one else to
turn to. My adopted mom, tried to send me to a homeless shelter, overe and over
again-where I would have been badly beaten-maybe to death, and where, I would
not have been able to breath. I have severe asthma, and most homeless smoke.

At the present time. I am
moved into a temporary duplex apartment. My adopted mom, ruined my credit
again, and does not want to help me, to stay in the new apartment, because she
is mad at me again, for complaining about how she treats me, and for
complaining about how she steals my belongings from me, and about how she
withholds my post mail from me-again. I have already had some problems with
this new apartment, in relation to my adopted mom-she came into the apartment,
when I was not here, and stole a ring from my shower curtain, she may have
taken other things as well. I am soo tortured and abused, by my adopted mom,
that I cannot remain in the U.S.. My life is in danger, all of the time.
Anytime my adopted mom, gets angry
with me, she steals from me, and threatens to leave me homeless, then, she
threatens to send me to the mental hospital, when I have no serious mental
illness. I am an applicant for political asylum, because I have complained to
authority figures, and to anywhere that will accept complaints, relevant to the
long, and growing list of problems, that she continues to cause me. No one in
the U.S., has responded in any meaningful way, to any of my serious complaints,
although, I have collected a few police reports, that I will be able to present
in an International court, to support my various cases, of: Violations, of
Civil and Human Rights, that I have experience for too long, here in the U.S.,
with no notice, or care, from anyone anywhere.
I know live, at: 812 Northeast 8th
Avenue, Apartment 812 Duplex, in Gainesville, FL U.S.A. 32601. I have paid
rent, for the full month of March, 2016. I do not know if my adopted mom, will
allow me to stay, for the month of April. She ruined my credit-again, and I
just re-contracted with Lexington Law, so I do not qualify, to rent on my
own-yet. The utilities, were switched over into my name, for this month.
However, when I asked, my adopted mom refused to give me anything official, or
legal in writing, that stated, that I am subleasing the apartment, for the
month, of April, 2016, and that makes me incredibly uncomfortable. She told me,
to pay the: 375.00 for March, with nothing in writing, to verify the fact, that
I am allowed to live here, or, to live on the street corner.

I am responsible. It was
not my fault, that my I was no longer able to attend my classes. I called a

1. Prepare a memo to the group that outlines the process
involved in creating a tax-exempt not-for-profit entity. Be sure to point out
particular alternative strategies, including the advantages and disadvantages
you believe the incorporating officers should spend time considering.
2. What resources are available on the
Internet to help this group understand the regulatory, taxation, and
performance measure issues that they will face as officers of a tax-exempt,
not-for-profit organization?
3. Visit a local NFP in your
neighborhood other than a religious facility. You can usually find a food bank,
or neighborhood service facility. Interview a member of the board preferably
the financial accountant or the Director. Ask them 3-5 questions about the
start-up of organization. Document your questions and their responses as a
supplement to your paper.
What is a non-for-profit organization? A non-for-profit organization, is an
organization which is established, as a non-business entity-meaning, the
organization does not operate for profits, or for the benefits of owners, or
shareholders. A non-for-profit organization, operates for the benefit, of the
public good, and the community as a whole. Because a non-for-profit
organization, is established to assist people, in various capacities, the U.S.
government, tries to encourage the formation of non-for-profits, and, private
contributions to non-for-profits, by providing certain tax exemptions, for
operations, and contributions.
The first step in establishing a non-for-profit organization, is
to define what type of non-for-profit organization, you want to establish.
There is information available of the web, at Wikipedia, and at the IRS
website, regarding the various non-for-profit non-business structures, that can
be utilized, when creating, a non-for-profit organization. The most common
type, of non-for-profit organization, is established as a corporation. I choose
to establish a corporation: Emergency International Internet Relief. The
different structures, and nomenclature, for the various non-for-profit
organization designations, allow for different charitable programs and
activities.
Although, it is clearly stated, that non-for-profit
organizations, must re-frame, for participation in politics, there are in
place, allowable exceptions. I read through the exceptions, which allow
non-for-profit organizations, to in some ways, contribute to the field of
politics, in the U.S. . I was not at all comfortable, by the thin line, that is
spanned, and the excuses that are made by non-for-profit organizations, when
they state that their affairs, are not really political activities, although,
they are clearly interacting, in the field of
politics.
I think that the U.S. government, should issue a strict
restriction, on non-for-profit organizations, participating in any political
activities at all. The IRS said, that a number of complaints, are filed, about
non-for-profit organizations, engaging in political activities, and then-even
after investigations, and the establishment of guilt, very little, other the a
warning, is ever done, to the non-for-profit organizations, who are violating
the rules, of their tax exemption status. The IRS, upon discovery of a
violation, of one of the rules, pertaining to a non-for-profit organization,
for participating in politics, is supposed to revoke, the non-for-profit organizations
tax exempt status, however, that rarely happens.
In order to establish a non-for-profit organization, as a
corporation, an individual must follow certain required guidelines, for:
articles of incorporation, bylaws, filing with the state, obtaining an employee
ID number, etc. .There are soo many requirements, which must be met, for a
corporation, to be established as a legally operable non-for-profit
organization, that, I choose to pay legalzoom.com, to establish my non-for
profit identity/organization, for me.
I paid legalzoom.com, a reasonable fee, after answering a
series of questions, pertaining to: what I wanted the non-for-profit to be
called, where I am located, what operational structure I wanted, how the
organization would be operated, etc., and legalzoom, set into motion, the
filing of paperwork and the obtaining of all legally required documents, and
regulative bodies, in order for me to operate, in the state of Florida, as the
president, and director, of my own, non-for-profit organization: Emergency
International Internet Relief. I am right now waiting, for the legal
documentation, establishing my non-for-profit, to arrive in the mail to me,
from legalzoom.
I have assisted with establishing, a non-for-profit organization,
in the state of Florida before. However, the process of writing the bylaws, was
long and tedious, and therefore, for my non-for-profit organization: Emergency
International Internet Relief, I choose to hire a company, called Rocket
Lawyers Incorporated, to write my bylaws for me. Rocket Lawyers Incorporated,
offered me 1 week, of free services, after having constructed my
non-for-profits bylaws for me, as well as the ability, to submit questions
online, to a lawyer, who specializes, in the establishment of non-for-profit
organizations. I am right now, waiting to hear back, from a legal
representative, at Rocket Lawyers Incorporated. I can already download, and
print, the bylaws, that the Rocket Lawyers Incorporated, have prepared for me.
There are resources available online, on the IRS, U.S. website, which provide
step by step directions, for establishing a non-for-profit organization,
without the assistance, of an online company, who will perform: the filing,
registration, and other required paperwork for you. Establishing a
non-for-profit organization, by going through each step on your own, without
the assistance of a lawyer, and experienced professionals, is a long and
tedious task-although, it can be done. I would not suggest establishing a
non-for-profit organization that way, just because it would be soo time
consuming, and, there are many legal requirements, which must be
met.
Non-for-profit organizations, under the auspice of
corporation, can be run in two different ways-as a membership organization, or,
as a board of directors only, organization. When a non-for-profit
corporation, is run as a membership organization, members help the board of
directors, and the president to decide, how the organization functions. When a
non-for-profit organization is run, as a board of directors only organization,
then, the board of directors, and the president of the non-for-profit, make the
decisions, pertaining to how the organization operates, who to accept financial
donations from, what services are provided to individuals, and the community,
etc. . When establishing a non-for-profit organization, it is important
for the board of directors to consider, what structure to adopt: a membership
structure, or a board of directors only structure, dependent on how much input,
and control, the board of directors, and the president, want over their
non-for-profit organization.
When operating, a non-for-profit organization, decisions pertaining to how the
organization operates, are crucial, to how well the organization, will be able
to assist people. When a non-for-profit organization, allows for membership,
the organization can get bogged down, by disagreements between various members,
who have different social concerns, and ideologies, about: how service should
be provided, to whom service should be provided, and where to accept financial
contributions from, etc. . It is important, for smooth transitions and delivery
of services, that, a non-for-profit organization be run, with as few
disagreements, as possible.
There are two main ways, to finance a non-for-profit organization: the first
major financing option, is to turn to the government, for funding and grants.
The second major financing option, is to rely, on donations from private
individuals, and private organizations. When accepting donations, a
non-for-profit organization, must consider, any stipulations and funding
allocation requirements, which are attached to the donations. The spending
requirements, attached to money donated from governments, varies to a great
extent, from stipulations for spending, that are attached to donations, granted
by individuals, and organizations, to
non-for-profits.
When accounting, for non-for-profit organizations-according to: Kattelus, Reck,
and Wilson (2010), donation monies are classified into, the following four
categories:
1. unrestricted net assets;
2. board-designated net assets;
3. temporarily restricted assets;
4. and permanently restricted assets.
(p. 583)
Unrestricted
net assets, are donations that can accessed, and utilized, to further the
charitable objectives and goals, of the non-for-profit organization, with no
stipulations, restrictions, or funding guidelines, as to how the money must be
spent. Board designated assets, are financial donations, which are designated
for use, in ways that the board of directors chooses, and therefore, to spend
these monies, the organization, must obtain the approval, of the board of
directors.
Temporarily restricted assets, are assets which are
available to be spent, only after certain criteria, by the organization is met.
Temporarily restricted assets are moved, for accounting purposes, from
temporarily restricted assets, to unrestricted assets, when the required
conditions, for spending the donations, have been met. Permanently restricted
assets, are assets that can never be spent, and which are often invested, and
earn interest. Most of the time, interest earned by the permanently restricted
assets, can be spent by the non-for-profit organization, however, the
permanently restricted asset itself, cannot be liquidated.
When accepting donations, for a non-for-profit
organization, it is important to consider, any restrictions, or stipulations,
that may be attached, to the spending of the money. It has be argued by some,
that it may be better, to rely on the government, for financial donations, and
grants, when operating a non-for-profit. A government, usually can afford to be
more reliable, in offering the same large sums, to a non-for-profit
organization, year after year. Non-for-profit organizations in the U.S., have a
history, of competing with the private sector, for qualified employees. Often
times, the talent pool, for possible employees, for non-for-profit
organizations, is small, because the private sector, is a more attractive work
environment.
The private sector, compared to the public sector (non-for-profit
organizations), traditionally pays a hirer salary, more benefits, and is a more
stable and reliable support system, for employees. Some non-for-profit
organizations, choose to accept government funding, over the contributions of
private individuals, and organizations, to attempt to maintain, a relatively
stable work environment, with higher pay, lower stress, and a higher retention
rate, of non-for-profit employees. Accepting government funding, can have
serious draw back however. Government donations, because of how the money is
allocated, do not generally require, the high accountability, and
verifications, for charity work and contributions out-put, that private
donations, and donations from other organizations
require.
Studies show, that non-for-profit organizations, which are
supported by private donations, and organizations, do a much better job,
serving individuals, and the community, with much needed, and required
services, because people who choose, as individuals, to donate to a
non-for-profit privately, usually, check the reputation of the organization,
and their track record, for not over spending on administration, and for
producing demonstrable-both: qualifiable, and qualitative results-for actively
working in the field, of charitable contributions to society. When non-for-profit
organizations, are held accountable for what they accomplish, in so far as
their charitable service goals are concerned, then, more gets
done.
Donating money, to a non-for-profit organization, for charitable services, is
an investment in people, and in a community. When people donate to
organizations, that are non-for-profit, which accept funding from both
government, and private individuals, then-even if the organizations are well
known, there are no guarantees, that the charitable objectives, and goals, that
the organizations purportedly works towards, will really receive the services,
that they have been promised. Many non-for-profit organizations exist, in the
U.S., and abroad, which are well known, and which receive copious amounts of funding,
and, however, do very little, to actually solve, any of the charitable issues,
that they are supposed to address-Amnesty International, and Human Rights
Watch, are examples.
Another problem, with government funded,
non-for-profit organizations, is competition, in the non-for-profit services
market. When government funds, large, and popular non-for-profit organizations,
that do not have to meet many measurable charitable goals, or standards-many
times, money, and attention, are diverted away, from smaller, more effective
non-for-profits, which offer services in the same, or similar areas, and, which
rely primarily of private donations-so, they are more effective. When the
non-for-profit market, becomes over crowded, the efficacy, of non-for-profit
organizations, that really want to help, becomes diluted, and less effective.
It has been suggested, that some new guidelines be introduced, to weed out
non-for-profit organizations, which do not really serve, for the benefit of
mankind, out of the non-for-profit service
market.
It has also been argued, by non-for-profit organizations,
which accept donations, primarily from private donors, and from organizations,
that the 501 (c ) (3 ) tax exemption benefits, that are offered by the IRS, in
the U.S., are not a strong enough incentive, to attract more financial
donations, from private contributors. Non-for-profit organizations, often times
struggle a great deal, to obtain financial contributions, to meet their program
goals. If the U.S., would be willing to increase the financial benefits,
associated with contributing financially, to non-for-profit organizations,
then, non-for-profit organizations in the U.S., that work very hard, toward the
betterment of society, could attract more financial
support.
Information, is available online, from the IRS, U.S.,
regarding the filing of a 501 (c ) (3 ) tax exemption qualification form, and
other documents, that are required, when operating, a non-for-profit
organization, in the U.S. .There is a financial threshold, that has to
met, before a non-for-profit organization, is required to file for a tax
exemption, and, certain non-for-profit organizations, like churches, are not
required to file with the IRS, in order to establish, their tax exemption
status. Financial, and accounting records, that a non-for-profit organization,
is required to file, with the IRS, in the U.S., are filed as, and considered,
public records, and are supposed to be, completely transparent, for public scrutiny.

I had no trouble, because I utilized legalzoom, establishing the paperwork, for
my non-for-profit organization. All the required documents, and paperwork, and
support associated, and required for establishing, and operating a
non-for-profit organization in the U.S., will arrive to me shortly, by mail. I
interviewed, Mrs. Pam Demers, and asked her what the most difficult task was for
her, when she established her non-for-profit organization, and she stated, that
it was writing the bylaws. My bylaws, were written by Rocket Lawyers
Incorporated. I too, have hand written bylaws for a non-for-profit organization
before, and I must agree with Mrs. Demers, that it was a time consuming, and
daunting task.
I then asked Mrs. Demers, how she came to be the director,
of her non-for-profit organization, and she stated, that she inherited it. That
he husband, initially established the non-for-profit organization, and then, he
returned to work as clergy, with a local church. Obtaining financing, for
non-for-profit organizations, can be a challenging task. When I worked in
Tallahassee, FL, in 1999, I was pre-medical, and employed by the Florida State
University College of Medicine P.I.M.S. Program. While employed with the F.S.U.
College of Medicine in Tallahassee, FL, I wrote a successful grant application,
to the United Way of Tallahassee, FL. As part of my volunteer work, with Mrs. Demers
non-for-profit organization, I was able to locate a grant online, that her
organization qualifies for.
Finally, I asked Mrs. Demers, how she handles the financial
side, of her non-for-profit organization, in so far as audits, and record keeping
is concerned. Mrs. Demers told me, that she hires out, for the services of a
CPA, to assist with any accounting requirements, associated with her
non-for-profit organization, including audits, and financial statements.
Running a non-for-profit organization, can be labor intensive, however, I see
it as a labor of love, and a fun, and helpful way, to give back to individuals,
and to the community as a whole.
